  • 2. Purposes and Legitimation of the processing of personal data:

The personal data provided by the Client at the time of contracting and pre-contracting, as well as personal data subsequently derived from contractual relationships, will be incorporated into the “Clients” treatment activity for which COSTA ENERGIA is responsible. , with the following purposes:

    • A. Management of contractual relationships

(Contract, User of the Virtual Office of COSTA ENERGIA or any type of contractual relationship): COSTA ENERGIA treats the Client’s personal data mainly for the purpose of providing, managing, controlling and maintaining the contractual relationships requested by him as: client, user of the Virtual Office of COSTA ENERGIA, or interested party linked to COSTA ENERGIA and, where appropriate, issue the corresponding invoices, manage possible debts, attend to incidents, complaints, claims, questions or suggestions that may arise, make inquiries and compare invoices , management of your contract procedures etc.

    • B. Management of pre-contractual relationships:

COSTA ENERGIA processes the Customer’s personal data in order to provide, manage, control and maintain the pre-contractual relationships requested by the latter. In certain contracts with COSTA ENERGIA, the Client may have to submit a previous request for an offer, therefore, in order to transfer the most beneficial offer and by virtue of the principle of free competition in the supply activity and free choice. As a supplier by consumers, COSTA ENERGIA can obtain information related to the SIPS (System of exchange of points of supply of natural gas and electricity) of the Client, through the Distribution Companies, the National Markets Commission and the Competition (CNMC), as well as publicly accessible sources such as the INE.

Legality of the Treatment: Legitimation by application of pre-contractual measures and by compliance with a legal obligation of the natural gas and / or electricity marketers and the applicable sector regulations.

    • C. Call recording:

COSTA ENERGIA makes recordings of calls with the Client in order to provide, manage, control and maintain pre-contractual and contractual relationships, internally audit and control the quality of the processes and services provided. Likewise, and if necessary, COSTA ENERGIA may use said recordings to face possible actions or claims that may be undertaken. In this sense, COSTA ENERGIA will inform the Client that the conversation is being recorded, so if the Client continues with it, they consent to said recording.

Legality of Treatment: Legitimation for the execution of the contract and for the satisfaction of the legitimate interest of COSTA ENERGIA.

    • D. Management with the Gas and Electricity Distribution Companies:

COSTA ENERGIA processes the Client’s personal data in order to contract the energy supply with the Distribution Companies. In addition, it analyzes the information related to the point of supply, the data related to the hourly load curve and the owner’s consumption, so that it can advise the Client about their consumption and how to reduce their bill. The Distribution Company will make this information available to COSTA ENERGIA through the channels established in the protocols for the exchange of information, security and confidentiality by the regulations in force for this purpose. In the event of non-payment of the services contracted by the Client, the Information System of supply points of the Distribution Companies may be informed, which may be accessed by the Office of Changes of Supplier and the Marketers that request it.

Processing legality: Legitimation for the execution of the contract and for compliance with a legal obligation of the natural gas and / or electricity marketers and the applicable sector regulations.

    • E. Consultation of information files on financial solvency and credit: COSTA ENERGIA

COSTA ENERGIA treats the Client’s data in order to carry out analysis of the Client’s financial risks and to collate their financial and credit solvency data related to the fulfillment and non-fulfillment of monetary obligations, through companies that provide services for capital solvency, credit and prevention. of fraud. Based on these consultations, COSTA ENERGIA may adopt decisions with legal effects or that affect it, and may, as a consequence, not enter into force the Contract or make its validity conditional on a payment guarantee. However, COSTA ENERGIA will always grant the Client the possibility of alleging everything it deems pertinent in order to defend its right or interest. In the same way and subject to current regulations, the Client is informed that the breach of the monetary obligations assumed by virtue of the contract may lead to the inclusion of their personal data in a file related to the fulfillment or non-fulfillment of monetary obligations.

Legality of the Treatment: Legitimation for the satisfaction of the legitimate interest of COSTA ENERGIA insofar as it is necessary to know the credit capacity of a Client and thus avoid possible fraudulent conduct. In this sense, the data protection rule does foresee the inclusion and consultation of companies to this type of files.

    • F. Fulfillment of accounting, legal, fiscal and administrative obligations:

COSTA ENERGIA treats the Customer’s data in order to comply with the accounting, legal, fiscal and administrative obligations associated with the contractual relationships. Legality of the Treatment: Legitimation for the execution of the contract and for compliance with a legal obligation.

    • G. Energy poverty programs:

COSTA ENERGIA maintains agreements with different public bodies in order to provide energy supply to vulnerable Customers in certain cases of energy poverty. Legality of the Treatment: Legitimation for the execution of the contract and for the satisfaction of legitimate interests of the public Bodies in order to assist those most vulnerable people.

    • H. Donation Programs:

COSTA ENERGIA maintains agreements with different non-profit organizations in order that the Client can participate in donation programs. Legality of the Treatment: Legitimation by consent of the Client. In no case does the withdrawal of this consent condition the execution of the contract.

    • I. Essential supplies:

 

COSTA ENERGIA could process specially protected personal data of the Client, in order to justify the maintenance of the supply even in case of non-payment, for situations of medical emergencies such as the need to maintain oxygen machines or other similar ones.

Legitimacy of the Treatment: Legitimation necessary to protect vital interests of the Client or of another natural person who lives in the home.

    • J. Automated individual decision-making, including profiling:

Provided that the Client has given their consent, and in order to offer them at all times (even after the contractual relationship has ended), the best solutions and services adapted to their profile, COSTA ENERGIA could process the Client’s data in an automated way to individual decision-making, including profiling, that produce legal effects on it or significantly affect it in a similar way, such as: cookie browsing data, historical and statistical data, data that can be obtained through other sources information (public access sources and social networks), in order to keep you informed about activities, promotions, raffles, news in COSTA ENERGIA products and services that may be of interest to you through any means of communication (telephone, networks social media, postal mail, email or other equivalent means).

Legality of the Treatment: Legitimation by consent of the Client. In no case does the withdrawal of this consent condition the execution of the contract.

    • K. Communication of the Client’s data for the submission of information on activities, promotions, raffles, news in products and services of the Business Group and Collaborators:

  • 3. Origin of personal data

The personal data that COSTA ENERGIA treats of its Clients are the data that the Client voluntarily provides during the pre-contracting and contracting processes, as well as those that subsequently derive from contractual relationships, including the following categories of data: Identifying data; Economic, financial and solvency data; Data of personal characteristics and social circumstances; Connection, geolocation and navigation data (in the event that the Client interacts with COSTA ENERGIA through the Virtual Office); and Commercial Information Data.

In this sense, the Client is responsible for ensuring that their personal data is true, accurate and up-to-date, guaranteeing at all times that all the documents that they provide to COSTA ENERGIA are their property or that they have been authorized for transfer to COSTA ENERGY. Non-completion by the Client of the fields that appear as mandatory in the different contracting forms, may prevent the contracting of products or services requested from being carried out. 

COSTA ENERGIA will not process special categories of the Client’s personal data (sensitive data).

In order to manage the contractual and pre-contractual relationships, COSTA ENERGIA may obtain information related to the SIPS (System for the exchange of natural gas and electricity supply points) of the Client, through the Distribution Companies, the National Markets Commission and Competition (CNMC), as well as publicly accessible sources such as the INE.

COSTA ENERGIA can also obtain information regarding solvency, delinquency and, in general, financial or credit risk indicators of the Client, through companies that provide services for capital solvency, credit and fraud prevention.

 

  • 4. Personal data of third parties

In the event that the personal data provided during the pre-contracting and contracting processes, as well as those that subsequently derive from the contractual relationships, belong to a third party, the Client guarantees that he has informed said third party about this Policy of Privacy and Data Protection, and has obtained your authorization to provide your data to COSTA ENERGIA for the purposes indicated. It also guarantees that the data provided is true, accurate and up-to-date, being responsible for any damage or loss, direct or indirect, that may be caused as a result of breach of such obligation.

  • 5. Terms or criteria for the conservation of personal data

COSTA ENERGIA will process and keep the Client’s personal data as long as the contractual relationship is maintained, or during the years necessary to comply with the applicable legal obligations and sectoral regulations. Personal data will be blocked when they are no longer necessary for the purpose for which they were collected, being only available to competent Public Administrations, Courts and Tribunals, and Data Protection Authorities, for the attention of possible responsibilities arising from the treatment, during the period of prescription of these. Once the aforementioned period has elapsed, COSTA ENERGIA will proceed to delete the Client’s personal data.

Once the contractual relationship is terminated, provided that the Client has given their consent, the personal data will be kept indefinitely in order to keep you informed, through any means of communication, about activities, promotions, raffles, product news and services of COSTA ENERGIA, of the Group Companies (for the purposes of article 42 of the Commercial Code) and of collaborating and / or affiliated companies (with which COSTA ENERGIA has collaboration agreements), in relation to the sectors: Energy, Telecommunications , Legal, Consulting, Construction, Real Estate, IT, and related sectors.

  • 6. Assignments and recipients of personal data

All communications and assignments that COSTA ENERGIA makes of the Client’s personal data will be necessary for the fulfillment of the aforementioned purposes and for the fulfillment of the legal obligations and applicable sectoral regulations, and will be in relation to the following Companies and Public Bodies:

    • Gas and electricity distribution companies, in order to contract the energy supply on behalf of the Client, access to the network, the Client’s identity, address, consumption, etc. In the event of non-payment of the services contracted by the Client, the Information System of supply points of the Distribution Companies may be informed, which may be accessed by the Office of Changes of Supplier and the Marketers that request it.

    • Suppliers to whom COSTA ENERGIA contracts part of the services, in order to comply with the contractual relationship with the Client and with whom the perceptual Treatment Manager Contract has been signed. In no case may said Suppliers carry out commercial or promotional actions direct to the Client, with the corresponding responsibility falling exclusively on them in case of non-compliance.

    • Companies that provide financial and credit solvency services, in order to carry out analysis of financial or credit risks of the Client and collate their solvency data regarding compliance and non-compliance with monetary obligations.

    • Competent Public Administrations, Courts and Tribunals, and Data Protection Authorities, in order to comply with the applicable legal obligations.

    • Competent Public Organizations, in order to provide energy supply to vulnerable Clients in certain cases of energy poverty.

    • Non-profit organizations, in order for the Client to participate in donation programs, provided that the Client has given their consent.

    • Group companies (for the purposes of article 42 of the Commercial Code), and collaborating and / or affiliated companies (with which COSTA ENERGIA has collaboration agreements), in order to keep the Client informed, through any means of communication , on activities, promotions, raffles, news in products and services, in relation to the sectors: Energy, Telecommunications, Legal, Consulting, Construction, Real Estate, IT, and related sectors, provided that the Client has given their consent.

  • 7. Security in the processing of personal data

COSTA ENERGIA undertakes to process the data of its Clients, in accordance with the provisions of the applicable regulations on the protection of personal data and, in particular, to process those data to which it has access, applying the appropriate technical and organizational measures. to ensure a level of security appropriate to the risk, including: Pseudonymisation and encryption of personal data, where appropriate; the permanent confidentiality, integrity, availability and resilience of the treatment systems and services; the ability to restore the availability and access to personal data quickly in the event of a physical or technical incident; and the regular verification, evaluation and assessment of the effectiveness of the technical and organizational measures to guarantee the security of the treatment.

The Client has been informed of the Privacy and Data Protection Policy of COSTA ENERGIA, and gives her consent for the aforementioned purposes.
